      近日,“優(yōu)思益”被央視曝光“品牌故事是編的、國(guó)際大獎(jiǎng)是買(mǎi)的、專家網(wǎng)紅是雇的”。如此“包裝”出來(lái)的產(chǎn)品卻在各大平臺(tái)上成為“爆款”。營(yíng)銷(xiāo)公司編造“保健”神話、平臺(tái)靠流量獲利,多位明星、主播曾帶貨相關(guān)產(chǎn)品。

      Chinese authorities have launched a multi-agency investigation into the "YouthIt" brand following a state media exposé which alleges the supplement brand fabricated branding, purchased awards and utilized misleading marketing practices.

      4月1日,浙江杭州濱江區(qū)市場(chǎng)監(jiān)管部門(mén)對(duì)杭州索象營(yíng)銷(xiāo)策劃有限公司開(kāi)展了現(xiàn)場(chǎng)調(diào)查。當(dāng)?shù)厥袌?chǎng)監(jiān)管部門(mén)對(duì)杭州索象與廣州雅拉源之間業(yè)務(wù)關(guān)系等資料進(jìn)行調(diào)查取證。

      專家:所謂“進(jìn)口”保健品涉嫌虛假宣傳

      平臺(tái)方須承擔(dān)內(nèi)容與商品審核主體責(zé)任

      針對(duì)“優(yōu)思益”相關(guān)問(wèn)題,中國(guó)政法大學(xué)副教授、中國(guó)消費(fèi)者協(xié)會(huì)專家委員會(huì)專家朱巍在接受采訪時(shí)說(shuō),按照國(guó)家規(guī)定,如果是保健品,才可以宣傳有一些保健功能。保健品絕對(duì)不是自己說(shuō)的,需要相關(guān)資質(zhì)進(jìn)行注冊(cè)和認(rèn)證,發(fā)相關(guān)的保健標(biāo)識(shí),就是我們俗稱的藍(lán)帽子標(biāo)識(shí)。

      如果沒(méi)有藍(lán)帽子標(biāo)識(shí),是絕對(duì)不可以按照保健食品或按照保健品的方式來(lái)宣傳,這個(gè)案子中實(shí)際上它是嚴(yán)重違反廣告法及相關(guān)法律規(guī)定的。它根本就不是一個(gè)保健品,是一個(gè)典型的虛假宣傳行為。

      Legal experts said the case reflects serious violations of advertising laws. Zhu Wei, associate professor at China University of Political Science and Law, noted that only certified health supplements bearing the official mark can legally claim health benefits, describing the incident as a typical case of false advertising.


      專家建議,有關(guān)監(jiān)管部門(mén)須進(jìn)一步升級(jí)監(jiān)管手段,而平臺(tái)方必須承擔(dān)起內(nèi)容與商品審核的主體責(zé)任,從源頭切斷營(yíng)銷(xiāo)亂象的傳播鏈條。

      朱巍表示,審核如果較真來(lái)審,這種“李逵”和“李鬼”的事件,是一下子就可以戳穿的,整個(gè)過(guò)程中脫離了審核環(huán)節(jié)。到底誰(shuí)來(lái)審?按照電子商務(wù)法等,互聯(lián)網(wǎng)平臺(tái)即電子商務(wù)平臺(tái),在這個(gè)時(shí)候要承擔(dān)一定的審核責(zé)任。

      Zhu added that e-commerce platforms must strengthen oversight of product listings and promotional content.
