尚德機(jī)構(gòu)（紐交所:STG）打包抬價(jià)欺瞞消費(fèi)者且不守信用！Sunlands Training Group（NYSE：STG）deceives consumers grossly by inflating prices and lacks integrity!

本人于2022年6月9日通過(guò)武漢之道在線教育科技有限公司（時(shí)名為武漢尚德在線教育科技有限公司）繳納41588元報(bào)名參加西北師范大學(xué)戲劇與影視學(xué)專(zhuān)業(yè)同等學(xué)力申碩學(xué)習(xí)，其中85%為培訓(xùn)費(fèi)，15%為綜合服務(wù)管理費(fèi)。當(dāng)時(shí)口頭宣傳是，通過(guò)尚德報(bào)名，“尚德幫忙申請(qǐng)?jiān)盒＃诰€學(xué)習(xí)拿證，輔導(dǎo)入學(xué)后考試內(nèi)容，部分專(zhuān)業(yè)只考英語(yǔ)，輔導(dǎo)論文答辯，畢業(yè)通過(guò)率99%”。當(dāng)時(shí)口頭承諾的是2年就能結(jié)業(yè)拿學(xué)位證，但事實(shí)上拖延到了第3年，還在準(zhǔn)備論文階段。

On June 9, 2022, I paid ￥ 41,588 yuan through Wuhan Zhidao Online Education Technology Co., Ltd. (formerly known as Wuhan Shangde Online Education Technology Co., Ltd.) to enroll in the equivalent master's degree program in Drama and Film Studies at Northwest Normal University. Of this amount, 85% was for training fees and 15% for comprehensive service management fees. The verbal promotion at the time claimed that by enrolling through Sunlands Institution, "Sunlands Institution would assist with college applications, facilitate online learning to obtain certificates, provide tutoring for post-enrollment exam content (English-only tests for some majors), offer guidance for thesis defense, and ensure a 99% graduation pass rate." At the time, it was verbally promised that I could complete the program and obtain the degree certificate within two years. However, it has now been delayed to the third year, and I am still in the thesis preparation stage.

當(dāng)然，這是次要的，最重要的是，3月6日北京公司發(fā)來(lái)高達(dá)8000元的論文輔導(dǎo)費(fèi)繳費(fèi)通知！當(dāng)初繳納了41588元，怎么還要再交8000？本人就要求尚德機(jī)構(gòu)代繳，但一直未獲回應(yīng)。

While this is secondary, the most important issue is that on March 6, the Beijing company sent a notice requiring an additional 8,000 yuan for thesis guidance fees! I had already paid 41,588 yuan, so why do I need to pay another 8,000 yuan? I requested that Sunlands Institution pay this fee on my behalf, but I have not received any response.

本人就上網(wǎng)查詢(xún)學(xué)校學(xué)費(fèi)究竟多少，在“在職研究生招生信息網(wǎng)”上查詢(xún)?cè)擁?xiàng)學(xué)費(fèi)僅6000元，遂又聯(lián)系西北師大同力申碩招生老師詢(xún)問(wèn)得知，學(xué)校學(xué)費(fèi)的確僅6000元！

I then went online to check the actual tuition fees charged by the university and found on the "On-the-job Graduate Admissions Information Website" that the tuition fee for this program is only 6,000 yuan. I further contacted the admissions office for the equivalent master's degree program at Northwest Normal University and confirmed that the school's tuition fee is indeed only 6,000 yuan!

但這三年來(lái)，尚德機(jī)構(gòu)僅提供了英語(yǔ)輔導(dǎo)課以及組織聯(lián)絡(luò)服務(wù)，這么計(jì)算，尚德提供的英語(yǔ)培訓(xùn)課就是41588*85%-6000=29349.8元 ！也就是說(shuō)尚德機(jī)構(gòu)提供的英語(yǔ)輔導(dǎo)課價(jià)值是西北師大學(xué)校提供的14門(mén)課程價(jià)值的約近5倍！這嚴(yán)重不合理！

However, over the past three years, Sunlands Institution has only provided English tutoring courses and organizational liaison services. Based on this calculation, the English training course provided by Sunlands amounts to 41,588 * 85% - 6,000 = 29,349.8 yuan! This means that the value of the English tutoring course provided by Sunlands is nearly five times the value of the 14 courses provided by Northwest Normal University! This is highly unreasonable!

為了核查這個(gè)問(wèn)題，我又聯(lián)系了尚德機(jī)構(gòu)客服詢(xún)問(wèn)單獨(dú)報(bào)名同力申碩英語(yǔ)培訓(xùn)班僅3980元！然而，打包價(jià)竟然折合29349.8元 ！也就說(shuō)打包后的申碩英語(yǔ)培訓(xùn)課價(jià)值是單獨(dú)申碩英語(yǔ)培訓(xùn)課的7倍有余！

總體來(lái)說(shuō)就是，尚德機(jī)構(gòu)將價(jià)值6000元的學(xué)校課程和價(jià)值3980的英語(yǔ)輔導(dǎo)課打包后就賣(mài)出了41588*85%=35349.8元的高價(jià)！

To verify this issue, I contacted Sunlands's customer service and learned that the fee for enrolling in the equivalent master's degree English training course separately is only 3,980 yuan! However, the bundled price is equivalent to 29,349.8 yuan! In other words, the value of the bundled English training course is more than seven times the price of the standalone English training course!

In summary, Shangde Institution packaged a school course worth 6,000 yuan with an English tutoring course valued at 3,980 yuan and sold the bundle for an exorbitant price of 35,349.8 yuan, which is 85% of 41,588 yuan!

更有意思的是，經(jīng)過(guò)一番協(xié)調(diào)溝通后，尚德機(jī)構(gòu)最初答應(yīng)退款2800，并告訴我退學(xué)后就無(wú)法進(jìn)行后續(xù)論文答辯，但我咨詢(xún)過(guò)西北師大學(xué)校同力申碩辦退尚德機(jī)構(gòu)的學(xué)并不影響后續(xù)論文答辯，之后尚德機(jī)構(gòu)就又聯(lián)系我說(shuō)一分錢(qián)都不退了！尚德機(jī)構(gòu)這是何等的言而無(wú)信！

However, after some communication, something even more interesting came to light.Sunlands Institution initially agreed to refund me 2,800 yuan and told me that dropping out would disqualify me from subsequent thesis defenses. But, after I consulted Northwest Normal University’s Office for Equal-Master’s Degree Applications, I learned that withdrawing from Sunlands Institution would not affect my eligibility for the thesis defense. Following this, Sunlands Institution contacted me again, now refusing to refund a single penny! What a blatant lack of integrity from Sunlands Institution!

我再重復(fù)一遍：請(qǐng)尚德機(jī)構(gòu)退還8000元學(xué)費(fèi)，我自行繳納學(xué)校的8000元論文培訓(xùn)指導(dǎo)費(fèi)，或者由尚德機(jī)構(gòu)代繳這筆8000元論文培訓(xùn)指導(dǎo)費(fèi)！其他問(wèn)題也就既往不咎了！

Let me reiterate: I demand that Sunlands Institution refund the 8,000 yuan tuition fee. I will personally pay the 8,000 yuan thesis training and guidance fee to the school, or Sunlands Institution can pay this 8,000 yuan thesis training and guidance fee on my behalf! If this is resolved, I will let go of all other issues!

事實(shí)上，尚德機(jī)構(gòu)與西北師大并沒(méi)有合作關(guān)系，但他的宣傳明顯存在誤導(dǎo)。尚德機(jī)構(gòu)作為經(jīng)營(yíng)者對(duì)消費(fèi)者隱瞞真相，沒(méi)有如實(shí)告知，違反《消費(fèi)者權(quán)益保護(hù)法》第二十條第一款規(guī)定，經(jīng)營(yíng)者向消費(fèi)者提供有關(guān)商品或者服務(wù)的質(zhì)量、性能、用途、有效期限等信息，應(yīng)當(dāng)真實(shí)、全面，不得作虛假或者引人誤解的宣傳。

In fact, Sunlands Institution does not have a cooperative relationship with Northwest Normal University, yet its promotional activities clearly contain misleading information.

Sunlands Institution, as an operator, concealed the truth from consumers and failed to provide accurate information, thereby violating the first clause of Article 20 of the "Consumer Rights and Interests Protection Law." This law stipulates that operators must provide consumers with truthful and comprehensive information regarding the quality, performance, usage, and validity period of goods or services, and must not engage in false or misleading advertising.

依據(jù)《中華人民共和國(guó)消費(fèi)者權(quán)益保護(hù)法》第二十六條的規(guī)定：“經(jīng)營(yíng)者在經(jīng)營(yíng)活動(dòng)中使用格式條款的，應(yīng)當(dāng)以顯著方式提請(qǐng)消費(fèi)者注意商品或者服務(wù)的數(shù)量和質(zhì)量、價(jià)款或者費(fèi)用、履行期限和方式、安全注意事項(xiàng)和風(fēng)險(xiǎn)警示、售后服務(wù)、民事責(zé)任等與消費(fèi)者有重大利害關(guān)系的內(nèi)容，并按照消費(fèi)者的要求予以說(shuō)明。
經(jīng)營(yíng)者不得以格式條款、通知、聲明、店堂告示等方式，作出排除或者限制消費(fèi)者權(quán)利、減輕或者免除經(jīng)營(yíng)者責(zé)任、加重消費(fèi)者責(zé)任等對(duì)消費(fèi)者不公平、不合理的規(guī)定，不得利用格式條款并借助技術(shù)手段強(qiáng)制交易。
格式條款、通知、聲明、店堂告示等含有前款所列內(nèi)容的，其內(nèi)容無(wú)效。”
這個(gè)格式合同是尚德機(jī)構(gòu)提供的格式合同，對(duì)于論文輔導(dǎo)費(fèi)究竟應(yīng)該算不算培訓(xùn)費(fèi)，雙方發(fā)生分歧，有兩種完全不同的解釋?zhuān)鶕?jù)《民法典》第四百九十八條規(guī)定：“對(duì)格式條款的理解發(fā)生爭(zhēng)議的，應(yīng)當(dāng)按照通常理解予以解釋。對(duì)格式條款有兩種以上解釋的，應(yīng)當(dāng)作出不利于提供格式條款一方的解釋。”
這個(gè)格式合同是由尚德提供的，但是尚德機(jī)構(gòu)不認(rèn)為論文輔導(dǎo)費(fèi)屬于培訓(xùn)費(fèi)。現(xiàn)本人訴求，請(qǐng)求認(rèn)定論文輔導(dǎo)費(fèi)屬于培訓(xùn)費(fèi)，請(qǐng)尚德機(jī)構(gòu)代繳8000元論文輔導(dǎo)費(fèi)！

According to Article 26 of the "Consumer Rights and Interests Protection Law of the People's Republic of China": "When using standard terms in business activities, business operators shall prominently draw consumers' attention to the quantity and quality of goods or services, price or fees, performance period and methods, safety precautions and risk warnings, after-sales services, civil liabilities, and other matters of significant interest to consumers, and provide explanations upon the request of consumers.
Business operators shall not use standard terms, notices, statements, or in-store announcements to exclude or restrict consumer rights, reduce or exempt their own responsibilities, or impose additional responsibilities on consumers, thereby creating unfair or unreasonable terms for consumers. They shall not use standard terms combined with technical means to force transactions.
If standard terms, notices, statements, or in-store announcements contain the aforementioned content, such content shall be invalid."

This standard contract is provided by Sunlands Institution. There is a dispute between the parties regarding whether the thesis guidance fee should be considered part of the training fee, with two completely different interpretations. According to Article 498 of the "Civil Code": "If there is a dispute over the interpretation of standard terms, the interpretation shall be based on the common understanding. If there are two or more interpretations of the standard terms, the interpretation unfavorable to the party providing the standard terms shall prevail."

This standard contract is provided by Sunlands Institution, but Sunlands Institution does not consider the thesis guidance fee to be part of the training fee. My request is to recognize the thesis guidance fee as part of the training fee and to demand that Sunlands Institution pay the 8,000 yuan thesis guidance fee on my behalf!
